Terms of service

1. Overview. This website is operated by Nox & Lux ("we", "us", "our"), based in Canada. By visiting our site or buying from us, you agree to these Terms of Service, together with our Privacy Policy, Return Policy and Shipping Policy. If you don't agree, please don't use the site.

2. Eligibility. You must be at least the age of majority in your province, state or country to place an order. Our products are not intended for use by children.

3. Products and descriptions. We work hard to describe and show our products accurately. Colours may look slightly different depending on your screen, and some images are styled or illustrative. Natural silk can show small variations in sheen and texture; these are normal and are not defects.

4. Prices and payment. Prices are shown in the currency displayed at checkout and may change without notice. Taxes and shipping are calculated at checkout. If a product is listed at an incorrect price because of an error, we may cancel the order and refund you in full, even after it has been placed.

5. Orders. We may refuse or cancel any order, for example if a product is unavailable, if we suspect fraud, or if there is a pricing or description error. If we cancel an order you have paid for, we'll refund you in full.

6. Pre-orders. Pre-order items are charged when you order and ship on or around the estimated date shown. Ship dates are estimates and may change; we'll email you if they do. You may cancel a pre-order for a full refund at any time before it ships.

7. Shipping and returns. Shipping and returns are governed by our Shipping Policy and Return Policy, which form part of these terms.

8. Safe use of our products. Please read and follow all instructions and safety warnings included with your product and on its product page. For products with warming or cooling eye cups:

  • Heat only the detached eye cups, only in a microwave, and never for longer than the maximum time stated in the instructions.
  • Always test the temperature on the back of your wrist before use, and stop use immediately if you feel discomfort, burning or irritation.
  • Do not use damaged, torn, leaking or scorched eye cups.
  • Do not use on broken or irritated skin, after eye surgery, while wearing contact lenses, or if you cannot sense heat or remove the mask on your own, without first consulting a healthcare provider.
  • Keep out of reach of children.

Our products are wellness and comfort accessories. They are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or condition. Information on our site is for general purposes only and is not medical advice. Please consult a healthcare provider about any eye or health condition.

9. Limitation of liability. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages arising from your use of our site or products, including damage or injury resulting from misuse, from failure to follow the instructions and warnings, or from modification of the product. To the fullest extent permitted by law, our total liability for any claim relating to a product is limited to the amount you paid for that product. Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law, or any rights you have under applicable consumer protection legislation.

10. Indemnity. You agree to indemnify and hold us harmless from claims arising from your breach of these terms or your misuse of our products or site.

11. Reviews and content. If you submit reviews, photos or other content, you confirm it is your own, honest and lawful, and you grant us a non-exclusive, royalty-free licence to use, display and share it in connection with our business. We may remove content at our discretion.

12. Intellectual property. All content on this site, including the Nox & Lux name, logo, images and text, belongs to us or our licensors and may not be copied or used without our written permission.

13. Third-party services and links. Our store runs on Shopify, and we use third-party services for payments, shipping and reviews. Links to third-party websites are provided for convenience, and we're not responsible for their content or practices.

14. Changes to these terms. We may update these terms from time to time. The version posted on this page when you place an order applies to that order.

15. Governing law. These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without limiting any mandatory consumer protection laws where you live.
